These Terms govern access to Z8 Suite software, indicators, Expert Advisors, session tools, documentation, updates, and support (collectively, the “Services”). By purchasing, activating, installing, or using the Services, you agree to these Terms.
1. Software tools only
Z8 provides software tools for use with MetaTrader 5. Z8 is not a broker, dealer, exchange, investment adviser, financial adviser, commodity trading adviser, fiduciary, fund manager, signal-copying service, or custodian. Z8 does not hold customer funds, open brokerage accounts, execute trades on a user’s behalf, or provide personalized investment, legal, tax, or accounting advice.
2. Eligibility and user responsibility
You must be legally capable of entering a contract and permitted to use trading software where you live. You are solely responsible for selecting your broker, account type, leverage, instruments, settings, position sizes, risk limits, and trades; checking the Services in a demo or testing environment; maintaining backups; monitoring orders and positions; and complying with all laws, broker rules, tax duties, and platform requirements that apply to you.
3. License
Subject to payment and continued compliance, Z8 grants you a limited, personal, non-exclusive, non-transferable, revocable license for the purchased subscription term. You may not resell, sublicense, share license credentials, bypass activation controls, reverse engineer, decompile, modify, scrape, copy, redistribute, or create derivative products from the Services except where applicable law expressly permits it.
4. No promises or warranties
The Services are provided “as is” and “as available,” to the fullest extent permitted by law. Z8 disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, compatibility, and uninterrupted or error-free operation. Market data, broker feeds, spreads, slippage, latency, connectivity, platform updates, third-party outages, user settings, and market conditions can affect results. No feature, alert, zone, timer, advisory, example, statistic, testimonial, backtest, or historical result guarantees any outcome.
5. Trading risk and independent judgment
Trading is speculative and may result in substantial loss. Leverage can magnify gains and losses, and in some circumstances losses may exceed deposits. You must use independent judgment and seek advice from appropriately licensed professionals if needed. The complete Risk Disclosure forms part of these Terms.
6. Third-party services
The Services may depend on MetaTrader 5, brokers, payment providers, data providers, operating systems, internet services, or other third parties. Z8 does not control and is not responsible for their acts, omissions, pricing, data, security, availability, changes, execution quality, or terms. Z8 is an independent product and is not affiliated with, sponsored by, or endorsed by MetaQuotes or any broker unless expressly stated.
7. Limitation of liability
To the fullest extent permitted by law, Z8 and its owners, officers, employees, contractors, licensors, and affiliates will not be liable for lost profits, trading losses, loss of funds, missed trades, erroneous orders, loss of opportunity, loss of data, business interruption, reputational harm, or any indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to the Services, even if advised that such loss was possible.
To the fullest extent permitted by law, Z8’s total aggregate liability for all claims relating to the Services will not exceed the amount you paid to Z8 for the affected Service during the twelve months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
8. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Z8 and its personnel from claims, losses, liabilities, and reasonable costs arising from your trading activity, misuse of the Services, violation of these Terms, infringement of another person’s rights, or breach of applicable law.
9. Suspension, updates, and termination
Z8 may update, modify, suspend, or discontinue features when reasonably necessary for security, legal compliance, platform compatibility, maintenance, or product development. Access may be suspended or terminated for non-payment, license abuse, security threats, fraud, unlawful use, or material breach. Provisions that by their nature should survive termination—including intellectual property, disclaimers, liability limits, and indemnities—will survive.
10. Changes and disputes
Z8 may update these Terms prospectively by posting a revised date. Material changes will apply as required by law. The parties should first attempt to resolve disputes in good faith. Any mandatory consumer rights and non-waivable protections remain unaffected. Governing-law, venue, entity, and notice provisions should be finalized for Z8’s operating jurisdiction before commercial launch.
